We collect your name, email address, phone number, state and zip code when you request a quote through the Site or use the “Contact” feature on the Site for purposes of obtaining insurance coverage. We may collect some or all of the same information if you speak to or otherwise interact with (e.g., by email or text) with one of our customer service representatives. In order to match you with available insurance options, we may further collect your full address, birth date, social security number, Medicare/Medicaid coverage status, and names of your dependents. We do not collect payment card or bank account information; any payments for insurance are made directly to the insurance carrier. It is not necessary to disclose personal medical information to seek insurance coverage and we do not intend to collect or retain any such information that you may bring to our attention.

We may also obtain personal information about you from third parties, including, service providers and lead sellers. This information may include name, address/location (state and/or zip code), email address, phone number, gender, birth date, Medicare/Medicaid coverage status, IP address, and/or lead identification number.

Automatic Collection

Whenever you interact with the Site, we, as well as our service providers, may use assorted technologies, such as cookies and other technologies, that automatically or passively collect data about how the Site is being accessed and used. This data may include browser type, unique number assigned to identify the device, operating system, application version used to access the Site, click path taken through the Site, your use of features or applications within the Site, and other usage information (“Use Data”). This information helps us manage, improve and customize our Services, including the Site’s features and functionality, and may be used to identify you like personal information.

  • respond to law enforcement requests and as required by applicable law, court order, or governmental regulations, or comply with subpoena, court order, legal process or obligations;

HOW WE SHARE PERSONAL INFORMATION.

  • Insurance, Medical Alert/Device, and Related Industries. We may disclose your personal information to third parties to assist with requests for information regarding insurance coverage, quotes for insurance coverage, medical alert devices, life insurance, auto insurance, walk-in tubs, and related products or services, including to insurance carriers, call centers and marketing partners.
  • Service Providers.  We engage with select service providers who provide services to support our operations such as: web hosting; data management; advertising and marketing vendors, and other service providers.  Such service providers will be limited to using your personal information to provide their services to us, or as otherwise permitted by law. If you request services via a mobile device, your request will be transmitted via your mobile carrier’s network and your carrier may have access to it.  Consult your carrier’s privacy policy for additional information.
  • Certain Mobile Carriers.  If you request Services via a mobile device, your request will be transmitted via your mobile carrier’s network and your carrier may have access to it. Consult your carrier’s privacy policy for additional information.

  • Healthcarenetwork.io sold personal information (limited to name, address or location (zip code and/or county), email address, IP address, gender, data of birth, Medicare/Medicaid coverage status, and/or lead identification number) to our marketing partners to be able to offer insurance coverage options.  If you would like to have your information removed from such lists, please click the DO NOT SELL MY INFO button indicated above.
  • We do not knowingly collect the personal information of minors under age 16 from such minors and do not sell such information. Insurance products are directed to the adult/legal guardian as the covered individual, who may name their dependents in the course of seeking coverage.

Third-Party Marketing Disclosure

Under California Civil Code Section 1798.83 (The “Shine the Light” law), California residents with whom we have a business relationship can request certain information regarding what types of personal information, if any, we shared with third parties for the direct marketing purposes of the third parties and the identities of the third parties with whom we shared such information in the immediately preceding 12 months. Similarly, if you already  have insurance or related coverage, the information provided on our site may not be up-to-date or match information  from your provider. You will need to contact your insurance provider directly for coverage-related questions  concerning your in-force policy. 4. APPLICABLE LAW; ARBITRATION CLAUSE; CLASS ACTION WAIVER.  

a. Governing Law . Healthcarenetwork.io maintains and operates the Website and offers Services from its offices in the State of Florida,  United States. This Agreement is governed by and interpreted under the laws of the State of Florida, United States of  America. If any portion of this Agreement is deemed unlawful, void or unenforceable, then that part shall be deemed  severable and will not affect the validity and enforceability of any remaining provisions.  

b. Arbitration Clause . In the event of any disagreement regarding the Services or this Agreement or our Privacy Policy,  you agree to submit any disputes for resolution by the American Arbitration Association (“AAA”) under the AAA’s  Commercial Arbitration Rules in front of a single arbitrator selected according to such rules. The place of the  arbitration shall be Broward County, Florida. Judgment upon the decision rendered by the arbitrator may be entered in  any court having jurisdiction. Any decision by the arbitrator shall be final and binding, and except in cases of fraud or  gross misconduct by the arbitrator, the decision rendered shall not be appealable. Notwithstanding the foregoing  arbitration clause, in the event of any threat to Healthcarenetwork.io’s intellectual property rights or the Site, Healthcarenetwork.io reserves the right to  seek immediate injunctive relief in any court of competent jurisdiction.  

c. Class Action Waiver . Any and all disputes, claims, and causes of action arising out of or regarding the Services or this  Agreement or our Privacy Policy shall be resolved individually, without resort to any form of class action. You agree  that the arbitrator can only award relief in favor of the individual party seeking relief and only to the extent necessitated  by the individual party’s claims. Any relief awarded cannot affect other customers of Healthcarenetwork.io or users of the Website or  Services.  

5. LIMITATIONS ON LIABILITY .

FROM THE SERVICES, INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES REGARDING THE AVAILABILITY  OR OPERATION OF THE SERVICES OR FUNDING, OR ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR  FITNESS FOR A PARTICULAR PURPOSE.
